General Terms and Conditions, effective December 21st 2024
1. Applicability
1.1 These general terms and conditions apply to all quotations, assignments, and agreements between the studio and the client (individual or business).
1.2 Deviations from these terms are only valid if agreed upon in writing.
2. Services and Products
2.1 The studio offers custom work, repairs, workshops, advice, and consultancy.
2.2 The studio strives to carry out assignments to the best of its ability and understanding, taking into account the client’s wishes.
3. Quotations and Payments
3.1 All quotations are non-binding unless stated otherwise.
3.2 The client must pay 50% of the total amount in advance before work commences.
3.3 The remaining amount must be paid within 10 days after completion of the work.
3.4 In case of non-payment, the studio reserves the right to suspend further deliveries or services.
4. Cancellations and Changes
4.1 Cancellation of an assignment is only possible within reason and must be confirmed in writing.
4.2 If fabrics or materials have already been purchased for the assignment, these costs will be fully charged and are non-refundable.
4.3 For cancellations after work has started, 50% of the remaining costs will be charged.
4.4 Changes to the design or additional requests during execution may result in adjustments to costs and delivery time.
5. Liability
5.1 The studio is not liable for damage caused during transport by third parties.
5.2 In the event of delays due to unforeseen circumstances, the studio will endeavor to complete the assignment within a reasonable timeframe.
5.3 Any defects must be reported in writing within 7 days of delivery. After this period, the right to claim expires.
5.4 The studio’s liability is limited to the invoice amount of the specific assignment unless there is intent or gross negligence.
6. Warranty
6.1 The studio provides a 7-day warranty on repairs.
6.2 For custom work, a warranty ensures the client is entitled to corrections, provided the original assignment has not been changed.
6.3 Warranty is void if the product is used incorrectly or carelessly by the client.
7. Use of the Space
7.1 Use of the studio’s workspace or materials by third parties is only permitted with prior consultation and approval.
7.2 The client is liable for any damage caused to the space or materials during use.
8. Force Majeure
8.1 The studio is not liable for delays or shortcomings in the execution of assignments due to force majeure, including (but not limited to) natural disasters, pandemics, or supplier disruptions.
9. Applicable Law and Disputes
9.1 All agreements are governed by Dutch law.
9.2 Disputes will initially be resolved through mutual consultation. If this fails, disputes will be submitted to the competent court.
10. Final Provisions
10.1 If any provision of these general terms and conditions is found to be null or voidable, the remaining provisions shall remain fully effective.
10.2 The studio reserves the right to amend these terms. The most current version is always available upon request.
